Trojan Law Offices Convinces Federal Judge to Dismiss $43 Million Case.
On September 10, 2018, U.S. District Court Judge Cormac J. Carney issued a summary judgment order dismissing all thirteen claims in VBS Distribution, Inc, et al. v. Nutrivita Laboratories Inc. et. al., Case No. 8:16-cv-01553-CJC-DFM, Central District of California. The Vietnamese Broadcasting Service (VBS Television) alleged that a competing Vietnamese television station, KVLA, had stolen its trade secrets, infringed its trade dress, infringed its copyright, interfered with its contracts, and violated the antitrust laws. VBS also alleged false advertising claims against Robinson Pharma and the distributors of joint supplements manufactured by Robinson Pharma.
VBS’s counsel announced in 2016 that VBS would be seeking $43 million in damages. Lead counsel for the eight defendants, R. Joseph Trojan, said, “We are grateful that Judge Carney saw that VBS had no case to present to a jury. The case was always smoke and mirrors. Proving it on summary judgment on all thirteen claims was the challenge.”
It is not known whether VBS will appeal.
